Part B of EEOICPA provides compensation for workers, or their survivors, with radiation induced cancers, beryllium disease or silicosis (chronic silicosis - Nevada Test Site and Alaska only). Claimants whose claims are approved will receive a lump-sum payment of $150,000 and medical benefits for the covered illness. Some claimants paid under Part B will also receive benefits under Part E with up to $250,000 in lump-sum payments.

Part E of EEOICPA provides monetary compensation and medical benefits for employees of Department of Energy contractors and subcontractors, as well as eligible survivors, for covered illnesses or death related to exposure to toxic substances arising from employment at covered Department of Energy facilities. Part E also provides monetary compensation and medical benefits to uranium miners, millers, and ore transporters covered by Section 5 of the Radiation Exposure Compensation Act (RECA).

Survivors of energy employees may be eligible for compensation if the employee developed an illness due to exposure to a toxic substance at a DOE facility and passed away. Claims can be filed for employees that have filed before and passed before receiving all of their Part E award, or for an employee that never filed before. Survivors can receive a financial award from Part B, Part E or both, depending on circumstances.

We have been successful in overturning previously denied claims under Part E, and we are happy to review any denied claim to look for a path to approval.
